MINTEDVR MINTDRIVER is a virtual reality driving simulation. It is developed to support but not replace practical in-car driver training. While MINTEDVR MINTDRIVER is based on generally and internationally accepted driving practices You must check your local road rules and comply with your country’s specific driver training requirements before driving a real motor vehicle on public roads. Your local transport authorities may have specific requirements outlined in their road rules which may vary when compared to those in the simulation. These may include, but are not limited to, local speed limits, road markings, and traffic signage. You are responsible for complying with all locally applicable laws and regulations when operating a real motor vehicle on public roads. MINTEDVR LTD will not be liable for any damage(s) or injury(s) caused by user failure(s) to comply with any domestic laws including local transport legislation, road rules, and regulations enforced by local authorities. Introduction
Please read these Terms of Use (these “Terms”) carefully as they govern your use of and access to MINTEDVR LTD’s personalized services for using the Virtual Reality (“VR”) application MINTDRIVER, including our website and software applications.
The use of MINTEDVR LTD’s MINTDRIVER may be subject to additional terms and conditions presented by MINTDRIVER which are hereby incorporated by this reference into these Terms.
By signing up for, or otherwise using, MINTDRIVER, you agree to these Terms. If you do not agree to these Terms, then you must not use MINTEDVR LTD’s MINTDRIVER, MINTEDVR’s Analytic Dashboard or access any of the Content.
Service Provider
These Terms are between you (the “user”) and MINTEDVR LTD (the “Company”), Auckland, New Zealand.
Age and Eligibility Requirements
In order to use MINTEDVR LTD’s MINTDRIVER and access any Content, you need to: (1) be 13 years of age (or the equivalent minimum age in your home country) or older; (2) have parent or legal guardian consent if you are a minor in your home country; (3) have the power to enter a binding contract with us and not be barred from doing so under any applicable laws; and (4) not reside in a country where the Service is unavailable.
You also promise that any registration information that you submit to MINTEDVR LTD is true, accurate, and complete, and you agree to keep it that way at all times. If you are a minor in your home country, your parent or guardian will need to enter into these Terms on your behalf.
You can find additional information regarding minimum age requirements in the registration process. If you do not meet the minimum age requirements, then MINTEDVR LTD will be unable to register you as a user.
MINTDRIVER Product Description
MINTDRIVER is a Virtual Reality driver training and practice application designed to encourage users to think about how they can be safe drivers. MINTDRIVER provides insights into basic vehicle control, the practical application of road rules, traffic risk assessments, in-car distractions, and the importance of making safe decisions as a driver.
Subscribing to MINTDRIVER (the “Application”) gives users access to the MINTEDVR Analytics Dashboard the “Dashboard”). The Dashboard provides users with detailed information on their use of the Application such as the number of logins, cumulative driving log, number of MINTDRIVER scenarios passed and a scenario pass rate for the last 10 sessions.
MINTDRIVER Application
The Application can be downloaded at no cost from a VR Application Store (Meta/Pico). Once downloaded, the user will be able to access certain unlocked driving scenarios as a free trial. The free trail enables the user to decide if the Application is going to give them the required driving insights and practice. To access the locked scenarios of the Application the user will need to sign up for a paid monthly subscription via the MINTEDVR portal. Any application updates and enhancements will be released via the respective VR application stores. It is the user’s responsibility to keep the Application updated. Older versions of the Application may not work correctly and will not have the latest application features.
Hardware Requirements
To sign into and use the Application on a compatible Virtual Reality Headset the user will need to ensure that the VR Headset is connected to the Internet via suitable Wi-Fi connection. The Wi-Fi connection will also ensure that the relevant application usage information is transmitted to the MINTEDVR Analytics Dashboard. To access the Dashboard a user will need to log into their account via an Internet Browser. The Company is not responsible for any issues with downloading the Application from the VR application store(s), loss of information transmitted to the MINTEDVR Analytics Portal due to a poor Internet connection or any associated hardware issue.
MINTDRIVER Subscription
To continue using the Application after the free trial period the user will need to sign up to a monthly MINTDRIVER subscription at MintedVR. Subscription registration must be completed using a valid email address and an accepted, active credit/debit card. Privacy Policy – MINTEDVR
The monthly subscription is advance payment for accessing the Application for the next month and is automatically charged at the end of each monthly period. The monthly subscription period applies from the date and time a user first pays to subscribe to MINTDRIVER and runs to the same day of the following month at which point payment for the subsequent month is debited from their respectively saved credit/debit card. Example: if a user subscribes on 1st January, then their subscription will renew on 1st February, subsequently 1st March, and so on until termination. If the automatic payment cannot be processed for any reason the user will be advised via email promptly and on the same day. Access to the Application will be suspended until the subscription payment(s) are resumed.
If the user wishes to terminate their subscription, it will terminate at the end of the current and prepaid month as described above, and no partial refunds will be made. If for any reason the automatic monthly subscription does not go through due to an invalid/expired credit/debit card the user’s access will be suspended until the payment is made. The user will be advised of the issue via email promptly and on the same day.
The Company may from time to time change the price for the Paid Subscriptions, including recurring subscription fees, the Pre-Paid Period (for periods not yet paid), discounts for school/community users and will communicate any price changes to you in advance on reasonable notice. Price changes will take effect at the start of the next subscription period following the date of the price change. Subject to applicable law, by continuing to use the Application after the price change takes effect, you will have accepted the new price. If you do not agree to a price change, you can reject the change by unsubscribing from the applicable Paid Subscription prior to the price change coming into effect.
Tax rates are based on the rates applicable at the time of your monthly charge. These amounts can change over time with local tax requirements in your country, state, territory, or city. Any change in Tax Rate will be automatically applied based on the account information you provide.
Reactivate a cancelled subscription
In the event that you cancel your subscription or that it expires for any reason:
- you can re-activate it at any time within 60 days and re-access your personal data.
- But if not re-activated withion 60 days the Company reserves the right to delete that data. Re-activation after 60 days wil be possible but there is no guarantee that your previous data will be available.
You can request deletion of your personal data at any time and the Company will promptly delete it.
Use of the Application
The Application is intended to help you improve your driving skills and knowledge. You agree to use the Application only for this purpose and in accordance with these Terms.
Restrictions
You may not share, sell, rent, or transfer your subscription to any other person or entity. You may not use the Application for any commercial purposes or in any way that violates these Terms.
Intellectual Property
The Application and all of its content, including but not limited to graphics, audio, and text, are the intellectual property of the Company and are protected by copyright law. You may not copy, loan, disseminate, modify, or distribute any part of the Application without the Company’s prior written consent.
MINTEDVR and MINTDRIVER are trademarks of Mintedvr Limited. If you wish to identify The Application in a blog/article/review or in any other way, please identify them as “MINTDVR ™ and MINTDRIVER ™ are trademarks of Mintedvr Limited”.
Termination
The Company reserves the right to terminate your subscription at any time, for any reason, without notice or liability for any losses. You may also cancel your subscription at any time, but no refunds will be given for any unused portion of your subscription period.
Disclaimer of Warranties
The Application is provided on an “as-is” basis, and the Company makes no warranties, express or implied, regarding the Application’s performance, reliability, or fitness for any particular purpose.
Limitation of Liability
The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Application, including but not limited to damages for loss of profits, business interruption, or loss of data.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is located, which is Auckland, New Zealand, without regard to conflict of law principles.
Entire Agreement
These Terms of Use, the Disclaimer and Privacy Policy constitute the entire agreement between you and the Company regarding the Application and supersede all prior agreements and understandings, whether written or oral.
